Terms of Service
These Terms of Service (“Terms”) are a binding agreement between you and Pixelleaf Studios LLC, a New Jersey limited liability company (“Pixelleaf,” “we,” “us,” or “our”), which operates Tourpad (the “Service”). By creating an account or using the Service, you agree to these Terms. If you use the Service on behalf of a brokerage or team, you represent that you're authorized to accept these Terms for it.
1. Who can use Tourpad
You must be at least 18 and a real-estate professional (or acting for one). You're responsible for your account and for keeping your credentials secure. Notify us at support@tourpad.app if you suspect unauthorized use.
2. What Tourpad does
Tourpad provides open-house sign-in pages, lead capture, listing microsites, and tools to send follow-up and update emails to the people who sign in. Follow-up emails are sent through Tourpad's email infrastructure on your behalf — they display your name and route replies to your email address — or, if you connect a Google account, from that account. You decide the recipients, review the content, and choose to send. We provide the tools; the message is yours.
3. Your responsibilities with visitor data
You control the information your open-house visitors give you, and you agree that:
- You will obtain any consent and provide any disclosures that the law where you operate requires before collecting a visitor's information and before contacting them.
- You will only contact visitors in ways they've agreed to, and you will promptly honor unsubscribe requests.
- You will use the Service and the leads only for legitimate real-estate follow-up — never to send spam, harass, or share a person's information without a lawful basis.
- You will comply with all applicable laws, including anti-spam laws (such as the U.S. CAN-SPAM Act), telemarketing and messaging rules, privacy laws, and any real-estate advertising and disclosure rules that apply to you.
You are the party responsible to your visitors for how their information is handled. Tourpad acts on your instructions as your service provider (processor).
4. AI-assisted features
The Service uses artificial intelligence — including third-party AI models (for example, Google's) — to draft follow-up emails and to draft answers to questions your visitors ask, drawing on your listing details, documents you upload, and public property records. You acknowledge that:
- AI output is a draft for your review. It may be inaccurate, incomplete, or out of date, and you are solely responsible for reviewing, correcting, and approving anything before you send or publish it.
- AI output is not legal, financial, appraisal, or other professional advice, and it does not constitute a representation or warranty by Pixelleaf about the property or any matter.
- You will not rely on AI output for disclosures or statements the law requires you to make accurately; those remain your professional obligation.
5. Property data
The Service can display property information sourced from third-party providers of public records (for example, RentCast). This data is provided “as is,” may be inaccurate, incomplete, or outdated, and is not independently verified by us. You must independently verify any property detail before relying on it, republishing it, or presenting it to a buyer, and you are responsible for the accuracy of what you publish on your listing.
6. Acceptable use
You agree not to: upload unlawful, infringing, or harmful content; impersonate others; attempt to access accounts or data that aren't yours; probe, overload, or disrupt the Service; scrape it; use it to send unsolicited bulk email; misuse property or owner data (including any attempt to use it for skip-tracing or to contact property owners without a lawful basis); or use it to build a competing product. We may suspend or terminate accounts that violate these Terms or that put the Service or others at risk.
7. Plans, billing, and cancellation
- The Free plan is available at no charge. Paid (“Pro”) plans are billed in advance on a monthly or annual basis through Stripe.
- New agents may receive a free trial of Pro features. The trial begins when you publish your first listing and requires no credit card. When it ends, you move to Free unless you choose to subscribe.
- Paid subscriptions renew automatically at the end of each billing period until you cancel. You can cancel any time from the billing page; access continues until the end of the period you've paid for.
- Prices, including any founding-agent rate, are shown at checkout. We may change prices with notice; changes apply to your next renewal.
- Except where required by law or expressly stated at checkout, payments are non-refundable. Where a mid-cycle plan change is offered on prorated terms, the terms shown at the time of that change apply.
8. Your content and data
You keep all rights to the content you upload and the leads you collect. You grant Pixelleaf a limited, worldwide license to host, store, process, and transmit that content solely to provide and improve the Service for you (including sending it to the service providers in Section 9). You can export your leads as a CSV at any time, on any plan. We don't claim ownership of your data, and we don't sell it.
9. Third-party services
The Service relies on providers that process data on our behalf or that you connect, including: Stripe (payments); Supabase (database); Cloudflare (file storage and delivery); Vercel (hosting); ZeptoMail / Zoho and Resend (email delivery); Google (optional sign-in, Maps, and AI models); and RentCast (property data). Your use of any integration you connect may also be subject to that provider's terms. We aren't responsible for third-party services we don't control.
10. Intellectual property
The Service, including its software, design, and the Tourpad name and logo, belongs to Pixelleaf and our licensors. These Terms don't grant you any right to our branding except to display links and marks the Service provides in the course of normal use.
11. Disclaimers
The Service is provided “as is” and “as available.” We don't warrant that it will be uninterrupted, error-free, secure, or that it will produce any particular business result, nor do we warrant the accuracy of AI output or third-party property data. Tourpad is a tool; it is not legal advice, and it does not guarantee your compliance with the laws that apply to your business. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.
12. Limitation of liability
To the fullest extent permitted by law, Pixelleaf will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or loss of goodwill, arising out of or relating to the Service. Our total aggregate liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the twelve months before the claim, or US$100.
13. Indemnification
You agree to indemnify, defend, and hold harmless Pixelleaf and its members, officers, and agents from any claims, losses, and expenses (including reasonable legal fees) arising out of your content, your use of the Service, or your violation of these Terms or of any law — including claims by your open-house visitors or by property owners relating to how you collected, used, or disclosed their information.
14. Termination
You can stop using the Service and delete your account at any time. We may suspend or terminate access if you breach these Terms or to protect the Service or others. On termination, your right to use the Service ends; sections that by their nature should survive (such as content ownership, disclaimers, limitation of liability, and indemnification) will survive.
15. Changes to these Terms
We may update these Terms. If we make material changes, we'll update the date above and, where appropriate, notify you. Continued use after a change means you accept the updated Terms.
16. Governing law and disputes
These Terms are governed by the laws of the State of New Jersey, United States, without regard to its conflict-of-laws rules. Any dispute will be brought exclusively in the state or federal courts located in New Jersey, and you consent to their personal jurisdiction, except where applicable law gives you a non-waivable right to bring a claim elsewhere.
